Your privacy and trust are very important to El Peñón Foundation, I. A. P. Therefore, the data you provide us will be processed in accordance with the Federal Law on Protection of Personal Data Held by Private Parties, Article 17, section II, published in the Official Gazette of the Federation on July 5, 2010.

We inform you that El Peñón Foundation, I. A. P. (the "data controller"), with address at Av. San Josemaría Escrivá de Balaguer s.n., Colonia Santa Clara, C. P. 62930, Jonacatepec, Morelos, or by email at derechosarco@elpenon.edu.mx, will process the personal data, including sensitive data, that you provide in this form for the following purposes:

Suppliers, Donors and Service Providers

  • Activities related to the work of El Peñón Foundation, I. A. P.
  • Activities inherent to the various events of El Peñón Foundation, I. A. P.
  • Administrative activities of El Peñón Foundation, I. A. P.
  • Updating donor and prospect data.
  • Activities inherent to the various programs.
  • Identifying, locating and contacting the data subject, as well as the operation and administration of their file.
  • Sharing and protecting information with third parties contracted by the institution to provide products and services, when necessary, in which case the information will be dissociated from the data subject whenever possible.

Therefore, and to achieve the aforementioned purposes, the following personal data will be processed: name and surname, marital status, date of birth, telephone, office telephone, mobile phone number, position, personal email, company email, address (company or personal), profession, nationality, company name and tax information.

The data controller has designated a personal data officer (the "Privacy Officer"); therefore, you may limit the use or disclosure of your information by contacting the Privacy Officer at the following email: derechosarco@elpenon.edu.mx

Likewise, as of January 6, 2012, you will have the right to:

  1. I.Access your personal data in our possession and learn the details of their processing.
  2. II.Rectify them, if they are inaccurate or incomplete.
  3. III.Cancel them when you consider they are not required for any of the purposes stated in this Privacy Notice, are being used for unconsented purposes, or the contractual or service relationship has ended.
  4. IV.Object to their processing for specific purposes, as indicated by law.

This privacy policy will always be available on our website www.elpenon.edu.mx. We ask that you review this notice regularly to stay informed of any changes. You may always exercise your ARCO rights.

Applicants, Students and Parents

For El Peñón Foundation, I. A. P., the collection of certain personal data is necessary to carry out the activities intrinsic to its corporate purpose. In accordance with the Federal Law on Protection of Personal Data Held by Private Parties, Article 17, section II, published in the Official Gazette of the Federation on July 5, 2010, it has the legal and social obligation to comply with sufficient legal and security measures to protect the personal and sensitive data it has collected for the purposes described in this privacy policy.

From the moment you apply for admission to our Institution, you unconditionally accept our privacy agreement. We therefore recommend that you carefully read the following information. All of the above is done with the objective of ensuring that you have full control and decision over your personal data.

1. Data Controller

FUNDACIÓN EL PEÑÓN, I. A. P. (the "Institution") is an institution incorporated under the laws of the United Mexican States, with address at Av. San Josemaría Escrivá de Balaguer s.n., Colonia Santa Clara, C. P. 62930, Jonacatepec, Morelos, or by email at derechosarco@elpenon.edu.mx.

2. Personal Data

The Institution will collect from you the Personal Data necessary for the adequate provision of its services, either directly or through the completion of enrollment forms for the school year and/or scholarship application forms, in person or by electronic means. Such data includes, by way of example but not limited to:

2.1 Identification data

Full name, address, postal code, locality, neighborhood, municipality and state, home, mobile and/or work telephone, civil and religious status, signature of parent or guardian, RFC, CURP, place and date of birth, age, photographs, names of siblings, grandparents, family members, email, whether parents are alumni of El Peñón Foundation, I. A. P. or Montefalco, graduating class and level.

2.2 Employment data

Occupation of the father, mother or guardian, number of people living in the same household, address, telephone.

2.3 Financial data

Proof of income, current employment, movable and immovable assets, income and expenses, type of housing, type and layout of housing, home ownership, family assets and expenses, number of dependents.

2.4 Academic data

Current grade level, grade level for which the scholarship is requested, name of the school where studies were completed, grade point average.

2.5 Photographs and videos

Photographs and videos will be taken of you and your children when participating in events, inside and outside this campus.

3. Purpose of Data Processing

The Personal Data you have provided will be used for the following purposes:

  1. (i)The performance of all activities related to the services of El Peñón Foundation, I. A. P., including by way of example but not limited to: the processing of applications and admissions, collection activities, clarification, investigation and billing of fees, enrollment in educational programs of the institution or third parties.
  2. (ii)Assignment of fees, requests for donations from institutions, annual reports and donor reports.
  3. (iii)Preparation of statistical, promotional and financial reports.
  4. (iv)The creation and implementation of analytical and statistical processes necessary for the provision of Services.
  5. (v)The performance of any complementary or auxiliary activity necessary for the provision of Services.
  6. (vi)Making inquiries, investigations and reviews.
  7. (vii)Contacting you for any matter related to the Services or this Privacy Notice.
  8. (viii)Photographs of you and your children participating in events will be published in our printed and electronic promotional materials, website, annual reports and activity reports.

4. Data Transfer

The Institution requires transferring your Personal Data to the extent necessary for the provision of Services within and even outside the United Mexican Republic. The Institution undertakes to ensure that all legal principles of protection regarding the transfer of your personal data are observed and that this privacy policy is respected at all times.

In order to provide its Services, the Institution will transfer your Personal Data to:

  • a)Those donating institutions and those for which donations are managed, whether natural or legal persons, that share our social purposes.
  • b)Administrators of social programs.
  • c)Campaigns and events to raise donations.
  • d)Domestic and foreign donors.

ARCO Rights

5. How to Exercise ARCO Rights

Pursuant to the Federal Law on Protection of Personal Data Held by Private Parties, the data subject, either directly or through a duly authorized legal representative, may, as of January 6, 2012, exercise their rights of access, rectification, cancellation and opposition directly before the Special Public Attention Unit.

I. Access

Request at any time to know what data of yours has been collected and is held by the data controller.

II. Rectification

In the event that any of your data is inaccurate or incomplete, request its correction by attaching documentation that supports said modification.

III. Cancellation

Request at any time the cancellation of the data; if applicable, the data will enter a blocking period for subsequent deletion.

IV. Opposition

At any time the data subject may object, for justified cause, to the processing of their personal data.

The exercise of ARCO rights must be made in writing, addressed to the authority responsible for personal data, at the El Peñón school facilities:

The request must contain:

  • a)Name and address or other means to communicate the response.
  • b)Documents proving your identity or legal representation.
  • c)A clear and precise description of the personal data for which you seek to exercise the right.
  • d)Any other element that facilitates the location of your data.

The exercise of ARCO Rights is free of charge, but if you repeat your request within a period of less than twelve months, the costs will be three days of the current General Minimum Wage in Mexico City, plus V.A.T., unless there are substantial modifications to the Privacy Notice. The response to your request will be communicated within twenty business days from the date of receipt, which may be extended by a further twenty days in cases established by law.

6. Changes to the Privacy Policy

We reserve the right to make any substantial or total change to the Privacy Policy, which will be announced through a publication in a widely circulated newspaper, and/or through our website www.elpenon.edu.mx, and/or by email to the address registered for such purposes.

7. Special Attention Unit

Students, parents, donors, suppliers and service providers may contact the Special Attention Unit at the El Peñón school facilities, located at Av. San Josemaría Escrivá de Balaguer s.n., Colonia Santa Clara, Jonacatepec, Morelos, or by email at derechosarco@elpenon.edu.mx.
